​Original Gravity Tours – Tour Conditions Agreement

This document outlines Original Gravity Tours’ ("OGT") obligations to you and your obligations to us when you sign up for a tour.  This is very important information, so please read it carefully before you complete your reservation request.

1. Tour Price Guarantee:  OGT tour prices are subject to change without notice.  However, the price for your tour will be fixed and guaranteed once we receive your deposit.  For current tour prices, visit www.originalgravitytours.com or call us at (650) 430-9002.

2. No Airfare or Airport Transfers:  OGT tour prices do not include airfare from your country of origin to our destination cities (e.g., Munich), nor ground transportation between your destination/departure airport and your hotel.  Specifically, we do not arrange any travel beyond what is included in our tour description.

3. Included In the Price of Each Tour:  
  • Sightseeing with an Original Gravity Tours guide.
  • Accommodations each night.
  • All transportation from/to the hotel to/from each destination.
  • Local partner guides when utilized.
  • Admissions to sights seen as a group such as brewery tours.
  • All breakfasts (served in the hotel), lunches, and dinners.
  • All beer consumed while with the group.

4. Hotels:  The price of OGT tours are per person and assume two people traveling together on the same tour and sharing the same room.  Price includes one double room for two people.  One or two beds will be made available as necessary.  For individuals requiring a single room (solo travelers) there is an additional single room supplement fee per night (please refer to our Munich & Bamberg Brewery Tours page for current pricing).  OGT tours include six (6) nights lodging commencing on the night before the first day of a tour and ending on the last night of the tour.  For clarity, for tours running Monday - Friday, you will be able to check into your hotel on the Sunday immediately prior to the start of the tour, and you will be provided a room through and including Friday evening, checking out on Saturday.

5. Not Included in the Price of Each Tour:  The price of each tour does not include any of the following:
  • Airfare.
  • Transportation between your destination/departure airport and your hotel.
  • Any hotel expenses other than daily room charges and breakfast.
  • Anything prior to the first day of the tour (Monday) except for your hotel room on the night before your tour.
  • Anything after the last day of the tour (Friday).
  • Activities you may choose to undertake outside of scheduled tour activities including but not limited to beer and meals.
  • Optional activities or independent travel during the tour.
  • Any expenses associated with attending Oktoberfest.

If you choose to forgo any meal or activity provided with the tour, Original Gravity Tours is not obligated to refund any portion of your tour fee or to compensate you in any way for any non-tour activities you may choose to undertake. 

6. Itineraries Are Subject to Change:  OGT cannot guarantee that all sites/activities will available on the dates of your tour, however we will do our best to substitute similar sites/activities should one site/activity become unavailable (e.g., substitute one brewery tour for another).  The day and time of certain events may change as well.

7. Tour Payments:  
  • To confirm your reservation for an OGT tour you must agree to these Tour Conditions and you must pay us a deposit of $500.00 for each person.  We will send you a welcome letter with instructions for making your deposit payment.  We accept American Express, Discover, MasterCard and Visa.  Your deposit is fully refundable for up to thirty (30) days, after which you will forfeit your deposit should you decide to cancel your reservation.  You will also forfeit your deposit if you fail to adhere to the rules for joining our tours and are thus unable to join the tour you scheduled.
  • Your final tour payment is due ninety (90) days prior to the tour departure date, in one payment.  We will send you an electronic invoice for your final tour payment approximately 10 days prior to its due date.  It is your responsibility to make your final payment by the due date.  Missing the final payment deadline may result in your being removed from the tour and the loss of your deposit.  
  • If you sign up for a tour less than ninety (90) days prior to its departure date, the entire tour price must be paid in full immediately and is non-refundable.  Tour deposit refunds are discussed further below.
  • OGT uses a third-party service called Square to process credit card payments for your tour fees.  Please refer to the Square Security page for details about their security practices.

8. Tour Deposits – Cancellations and Refunds:
  • If we cancel a tour you have reserved, the entire amount you have paid to OGT for the applicable tour will be refunded to you within 10 days after the tour's cancellation.  Or, you may choose to transfer to another tour subject to availability (see "Transferring to another tour" below).  Once this occurs, OGT and its representatives have no other obligations to tour members for cancelled trips including any additional costs or fees related to the issuance and/or cancellation of airline tickets or other travel reservations not made by OGT.
  • Except as noted below, and except as noted further below under section 11, “Medical or Family Emergency Refund”, tour deposits are 100% refundable for thirty (30) days from the date they are received.  After thirty (30) days your deposit becomes non-refundable, and will be forfeited should you decide to cancel your reservation.   You will also forfeit your deposit if you fail to adhere to the rules for joining our tours and are thus unable to join the tour you scheduled.
  • Deposits made ninety (90) days or more before a tour departs become non-refundable thirty (30) days after the deposit is received by OGT or on the final payment due date (ninety (90) days before the tour’s departure date) whichever occurs first.
  • Cancellations must be in writing and sent via email to info@originalgravitytours.com; or mailed to Original Gravity Tours, 570 El Camino Real #150-113, Redwood City, CA 94063.  Cancellations become effective on the date received by OGT.

9. Tour Forms, Obligations, and Risks: To travel on a tour, and to qualify for cancellation credit, all tour members are required to review, sign and return our General Release and Waiver Agreement, our COVID-19 Waiver of Liability Agreement, and our COVID-19 Health and Safety Tour Conditions Confirmation prior to the beginning of the tour. Omitting important information, or altering any of these agreements, will render it invalid, and could result in expulsion from a tour at your own expense.

10. COVID-19 Health and Safety Tour Conditions:
  • You agree that if you test positive for COVID-19 during the 14 days prior to your tour departure date, you will notify OGT and acknowledge that you will not be able to join the tour. You understand that standard cancellation terms will apply.
  • You agree that upon arrival and prior to joining your tour, you will be able to present an authentic COVID-19 vaccination certificate showing date(s) and time(s) of vaccination(s) with the final dose having been given at least 14 days prior to your tour departure date.
  • You understand that you will also need to comply with specific requirements imposed by airlines and countries which may differ from the vaccine/testing requirements listed above. It is your responsibility to be aware of and to comply with airline carriers' and countries' requirements and present valid documentation for your flight and/or entry.
  • You understand there may be some restaurants, museums, transportation providers, etc. that require proof of vaccine before you will be allowed to enter. You understand that if you do not have the required proof, you will not be allowed entry and you will not receive a refund for any portion of the tour you miss as a result.
  • You agree to take personal responsibility for your own health and wellbeing while on tour. If you are asked to attest to your health on tour, you will do so honestly. If you show symptoms of COVID-19 or any other contagious illness, you will notify OGT immediately and will quarantine yourself, at your own expense, for the amount of time required by local authorities, usually 5-10 days, and/or until you have a negative test result.   You will not be able to continue on the tour and you understand that you will not receive a refund for any portion of the tour you miss while properly managing your health.
  • You agree to follow all safety precautions and health directives set by OGT, or by local officials. You understand that these safety precautions may include maintaining proper social distancing, the use of face masks (covering your nose and mouth), regular temperature checks, proper handwashing, the use of hand sanitizer, etc. If exempt from wearing a face mask or other such requirement due to health impairment or disability, you will carry proof, such as a doctor's note, to show if requested.
  • Noncompliance with the conditions listed in these COVID-19 Health and Safety Conditions by you or those traveling with you will result in your party not being able to continue on the tour.

11. Medical or Family Emergency Refund: OGT may provide you a refund if one of the following medical or family emergency events requires you to cancel your reservation. A medical or family emergency event must first occur less than 60 days prior to your tour's start date. It is OGT's sole discretion to determine if your situation is a refundable medical or family emergency event, and it is OGT’s sole discretion to issue a refund. For these purposes, we consider your traveling partner to be someone who shares the same accommodations with you and a family member to be your spouse, step-child, or blood relative in the first degree.
  • You, your travel partner or a family member dies or suffers an unexpected and disabling injury or illness requiring hospitalization or urgent medical care prior to joining the tour.
  • You, your travel partner or family member suffers a certifiable personal disaster (such as your home floods or burns down, or you are a victim of a serious crime) necessitating a change in travel plans.
  • You or your spouse are called into active military service or have leave revoked.
  • Loss of employment.

Documented illness due to coronavirus and/or COVID-19 may be considered a refundable medical or family emergency event. However, fear of infection or concern regarding prevalence of the virus in the tour location(s) will not be considered a refundable medical or family emergency event. 

12. Refund Request Process: If you need to cancel your tour you must notify OGT immediately in writing: sent via email to info@originalgravitytours.com or mailed to 570 El Camino Real
Suite #150-113, Redwood City, CA 94063-1212.  Cancellations become effective on the date received by OGT and are governed by this OGT Tour Conditions Agreement.

If you wish to request a refund for a medical or family emergency event and you have comprehensive travel insurance, you must first file a claim with your insurance provider before requesting a refund from OGT. OGT will process your request for refund only after you have filed a claim with your insurance provider and can demonstrate the final insurance payment or settlement.  Any OGT refund will be the amount equal to the amount you paid us for your tour less any insurance payment or settlement.

You also must provide the following documentation along with your cancellation notice and refund request: For an unexpected illness or injury, you must provide a letter from your attending physician, on the physician's letterhead, verifying the specific reason and date of the onset of the condition given for advice against traveling; in the event of a death, you must provide a copy of the death certificate; due to a crime, flood, fire or accident, you must provide a copy of a pertinent police, fire department or investigative report; for unexpected loss of your job, you must provide a letter signed by your employer specifying the date of termination, on the company's letterhead (including contact information).

13. Transferring to Another Tour:  Up to ninety (90) days prior to your tour’s departure date, you can transfer, with no transfer fee, to any other tour in the same calendar year that is not fully booked, applying the amount previously paid to the new tour.  If you transfer to a different tour, the price of that tour will be applied, effective on the date we confirm your transfer.  Transfers less than ninety (90) days before your tour’s departure date may not be possible.

14. Solo Travelers:  If you are traveling solo and wish to have your own hotel room, you must pay the single supplement shown on the Munich & Bamberg Brewery Tours page of our website.  Please note that a single supplement guarantees a private room, not a larger or nicer room. Single supplements are refundable if cancelled at least ninety (90) days prior to the tour departure date; those cancelled later will be forfeited.

15. Returned Payments:  If a payment to OGT is returned unpaid for any reason, we will assess a $25 returned item fee per occurrence. The fee(s) will be added to the applicable tour balance, and must be paid in full prior to your tour departure.

16. Insurance:  You may wish to consider purchasing trip cancellation and/or optional comprehensive travel and health insurance for your trip.  OGT does not provide travel or health insurance.

17. Participation:  Although we want everyone to have a good time, sometimes someone participating in a tour can misbehave or do things that are incompatible with the safety, comfort or convenience of other members of the tour or locals we encounter.  In those circumstances we have the exclusive right and discretion, to expel anyone from a tour at any time, without any claims or complaints by you against us.

18. Punctuality:  Because we travel as a group, it's important that we each respect the interests of all tour members.  This is especially important when we're traveling to and from various tour activities and have a scheduled departure time.  Tours members must arrive at designated locations (e.g., the hotel lobby or other meeting points) by the time requested by OGT.  If any tour member does not arrive by the designated time, OGT has the exclusive right and discretion to leave without you, without any claims or complaints by you against us.  If this happens, you will need to arrange your own transportation to get to our next destination.

19. Parts of OGT Tours are Physically Active:  On any OGT tour you should be capable and willing to participate — without any assistance — in the following levels of activity:
  • Be comfortable on your feet for two-hour walking tours, climbing lots of stairs, getting on and off transportation, plus standing and walking for up to two hours inside breweries and museums, and outdoors in all weather conditions.
  • Sleeping with some street noise in your hotel.  It is always recommended that you bring earplugs in the event you’re a light sleeper.
  • After orientation and transportation lessons, be able to navigate towns and cities on your own. 
  • Our tour guides cannot provide assistance for any of these activities. Tour members requiring help must be accompanied by an able companion who can be entirely responsible for providing the assistance.  If you have concerns about the physical demands of our tours, please call us. 

21. Be Considerate:  Travel is all about experiencing new things. Tour members are expected to be open-minded and to practice considerate social behavior toward one another and to any locals they may interact with while on the tour.

22. No Smoking or Vaping:  Smoking or vaping is not allowed on the bus, in hotel rooms or during group meals.  Smokers may only smoke outside in designated areas and downwind from the group and in accordance with local laws and regulations.

23. People with Special Needs:  We cannot accommodate pregnant women.  We also cannot accommodate passengers requiring wheelchair assistance as many of OGT’s tours activities are not wheelchair-accessible.  We suggest you contact us to discuss your particular needs before booking.

24. Age Requirement:  All participants in an OGT tour must be 21 years of age or older on or prior to the day the tour begins.
